How To Make A Claim

To make a claim, you must consider the following:

To make a claim reasonable; is it valid; if it's a money claim, have you calculated the amount correctly?

If your claim is £5000.00 or less, you will not be able to claim any legal fees, or if you are doing this yourself, you will not be able to claim for loss of earnings, travel to court or an amount for the time you have spent. You can claim costs for an Expert Witness, which could be for example, the AA / RAC who prepared a report on your car, an IT Consultant who prepared a report on your computer, a Surveyor who prepared a report on building works etc, and these costs are limited to £200.00.

If your claim is successful, you can claim back all the court fees you incurred.

If your claim is unreasonable, or, your claim had no substance in the first instance, the defendant can ask the court to make an order for "Wasted Costs", meaning you caused the defendant to spend monies unnecessarily.

If your claim is over £5000.00, and you lose your case, you will be responsible for the other side's reasonable costs.

When you set out your claim, it does not have to be detailed. Just include what the claim is for, and why you you are making the claim. You can give more detail to your claim when you draft your witness statement later on in the proceedings.
